Terms & Conditions

Please read the following terms and conditions carefully before commissioning a portrait. By placing an order and paying a deposit, you agree to the terms outlined below.

Booking & Payment

1. A non-refundable deposit of 50% is required to secure your booking and place on the waitlist. The remaining 50% balance is due upon completion of the artwork, prior to delivery.

2. Invoices will be issued for both the initial deposit and the remaining balance. The deposit invoice must be paid to confirm your booking. The final invoice will be issued once the artwork is complete and must be paid in full prior to dispatch.

​3. By paying the deposit, you agree to complete the full payment once the artwork has been finished. Watermarked, high-quality final images of the completed portrait will be shared before payment is requested.

​4. Payment can be made via bank transfer or PayPal. Details will be provided upon enquiry.

5. Prices are subject to change at any time; however, once your booking is confirmed, the agreed price will be honoured.

Timelines & Availability

6. All portraits are created to order and require a significant amount of time and care. As a result, there is often a waitlist, which may be several months long during busy periods.

7. Estimated timeframes will be provided upon enquiry; however, these are approximate and may vary depending on workload.

8. If you require your portrait for a specific date, please get in touch before booking to confirm whether this can be accommodated. Whilst every effort will be made to meet requested deadlines, this cannot be guaranteed unless agreed in advance.

Process

9. All portraits are created from photographs provided by the client. A mock-up of the composition will be shared prior to painting, and work will begin once this has been approved.

10. Every effort is made to ensure the final artwork reflects the agreed reference images and composition.

11. Progress updates may be shared throughout the process. Small adjustments may be requested during this time; however, major changes (including composition, size, or medium) cannot be made once work has begun.

Refunds & Cancellations

12. Deposits are strictly non-refundable, as they secure your booking and cover time allocated to your commission.

13. Once work on your portrait has begun, no refunds will be issued due to the bespoke nature of the artwork. This does not affect your statutory rights.

14. If, for any reason, the artist is unable to complete the commission, a full refund will be issued.

Copyright & Usage

15. All artwork remains the intellectual property of the artist, Anya Foulkes, even after purchase.

16. The client is purchasing the physical artwork only and may not reproduce, distribute, or commercially use the image without prior permission.

17. Clients are very welcome to share images of their commissioned artwork on social media for personal use. However, the artwork may not be used for any commercial purposes or financial gain without prior written permission from the artist.

18. The artist reserves the right to use images of commissioned work for portfolio purposes, including on social media, website, and promotional materials.

Reference Images

19. By providing photographs, the client confirms they have permission to use these images and grants the artist the right to use them for the purpose of creating the artwork and for promotional use.

Shipping & Delivery

20. Portraits are carefully packaged to ensure safe delivery. Shipping is currently available within the UK only.

21. Delivery timeframes will vary depending on workload and waitlist times. The artist is not responsible for delays caused by postal services once the artwork has been dispatched.

22. In the unlikely event of loss or damage during transit, the artist will assist in resolving the issue with the delivery provider.

23. Once the artwork has been successfully delivered to the address provided, responsibility for the item passes to the customer.

General

24. The artist reserves the right to decline a commission if it is not suitable.

25. These terms may be updated at any time. The terms agreed upon at the time of booking will apply to your commission.
